INTRODUCTION &amp; LEGAL ACCEPTANCE<\/strong><\/h4>\n<p>These Terms of Use (\u201cTerms\u201d) govern access to and use of all services, platforms, programs, and offerings provided by Enlightened Circle Foundation (\u201cECF\u201d, \u201cwe\u201d, \u201cour\u201d, \u201cus\u201d).<\/p>\n<p>These Terms apply across all interfaces including:<\/p>\n<ul>\n<li>Official website(s)<\/li>\n<li>Learning Management Systems (LMS)<\/li>\n<li>Mobile applications (including Swadhyan App and future platforms)<\/li>\n<li>Online and offline programs<\/li>\n<li>Retreats, satsangs, and events<\/li>\n<li>Membership communities<\/li>\n<li>Digital content and resources<\/li>\n<\/ul>\n<p>By accessing, registering, enrolling, or participating in any ECF offering, you (\u201cUser\u201d, \u201cParticipant\u201d, \u201cMember\u201d) agree to:<\/p>\n<ul>\n<li>Be legally bound by these Terms<\/li>\n<li>Comply with all policies, including Refund Policy and Code of Conduct<\/li>\n<li>Use the platform and services in a lawful and respectful manner<\/li>\n<\/ul>\n<p>If you do not agree, you must discontinue use immediately.<\/p>\n<h4><strong>02. NATURE OF SERVICES<\/strong><\/h4>\n<p>ECF provides <strong>spiritual, educational, and community-based services<\/strong>, including but not limited to:<\/p>\n<ul>\n<li>Meditation and self-development programs<\/li>\n<li>Guided sessions, satsangs, and retreats<\/li>\n<li>Digital courses, recordings, and content<\/li>\n<li>Membership-based community access<\/li>\n<li>Events, workshops, and experiential engagements<\/li>\n<\/ul>\n<p><strong>Important Clarification<\/strong><\/p>\n<ul>\n<li>ECF services are <strong>not medical, psychiatric, or therapeutic treatment<\/strong><\/li>\n<li>They are intended for <strong>personal growth and spiritual development<\/strong><\/li>\n<li>Participation is voluntary and self-directed<\/li>\n<\/ul>\n<h4><strong>03. USER ELIGIBILITY<\/strong><\/h4>\n<p>By using ECF services, you confirm that:<\/p>\n<ul>\n<li>You are at least <strong>18 years of age<\/strong>, or accessing under parental\/guardian supervision<\/li>\n<li>You are legally capable of entering into binding agreements<\/li>\n<li>You will provide accurate and complete information<\/li>\n<\/ul>\n<p>ECF reserves the right to deny access to any individual at its discretion.<\/p>\n<h4><strong>04. <\/strong><strong>ACCOUNT REGISTRATION &amp; SECURITY<\/strong><\/h4>\n<p>Where applicable, users may be required to create an account.<\/p>\n<p>You agree to:<\/p>\n<ul>\n<li>Maintain confidentiality of login credentials<\/li>\n<li>Be responsible for all activity under your account<\/li>\n<li>Notify ECF immediately in case of unauthorized access<\/li>\n<\/ul>\n<p>ECF shall not be liable for losses arising from misuse of your account.<\/p>\n<h4><strong>05. <\/strong><strong>CODE OF CONDUCT (MANDATORY COMPLIANCE)<\/strong><\/h4>\n<p>All participants are required to adhere to ECF\u2019s community standards.<\/p>\n<p><strong>Users shall NOT:<\/strong><\/p>\n<ul>\n<li>Disrupt sessions or community interactions<\/li>\n<li>Use abusive, offensive, or inappropriate language<\/li>\n<li>Harass, threaten, or disrespect mentors or participants<\/li>\n<li>Promote external agendas or solicitations<\/li>\n<li>Record or distribute sessions without authorization<\/li>\n<\/ul>\n<p><strong>Sanctity Clause<\/strong><\/p>\n<p>ECF operates as a <strong>discipline-based spiritual environment<\/strong>.<br \/>Participants are expected to engage with sincerity, respect, and responsibility.<\/p>\n<p>Violation may result in:<\/p>\n<ul>\n<li>Immediate suspension<\/li>\n<li>Permanent removal<\/li>\n<li>Forfeiture of access without refund<\/li>\n<\/ul>\n<h4><strong>06. INTELLECTUAL PROPERTY RIGHTS<\/strong><\/h4>\n<p>All content provided by ECF, including but not limited to:<\/p>\n<ul>\n<li>Videos, audios, and recordings<\/li>\n<li>Meditation practices and teachings<\/li>\n<li>Course materials and documents<\/li>\n<li>Branding, logos, and design elements<\/li>\n<\/ul>\n<p>are the <strong>exclusive intellectual property of ECF<\/strong>.<\/p>\n<p><strong>Users are strictly prohibited from:<\/strong><\/p>\n<ul>\n<li>Recording sessions (audio\/video\/screen capture)<\/li>\n<li>Reproducing, distributing, or sharing content<\/li>\n<li>Using content for commercial or public purposes<\/li>\n<li>Creating derivative works<\/li>\n<\/ul>\n<p>Unauthorized use may result in:<\/p>\n<ul>\n<li>Legal action<\/li>\n<li>Permanent access termination<\/li>\n<\/ul>\n<h4><strong>07. PAYMENT TERMS &amp; FINANCIAL COMMITMENT<\/strong><\/h4>\n<p>All payments made to ECF are governed by the <strong>Refund, Cancellation &amp; Payment Policy<\/strong>.<\/p>\n<p>By making payment, you acknowledge:<\/p>\n<ul>\n<li>Payments are <strong>non-refundable except under defined conditions<\/strong><\/li>\n<li>Access is granted upon confirmation<\/li>\n<li>Fees represent commitment to participation, not purchase of goods<\/li>\n<\/ul>\n<p>ECF reserves the right to:<\/p>\n<ul>\n<li>Modify pricing<\/li>\n<li>Introduce new fee structures<\/li>\n<li>Offer limited-time programs or memberships<\/li>\n<\/ul>\n<h4><strong>08. MEMBERSHIP &amp; ACCESS RIGHTS<\/strong><\/h4>\n<p>Membership or enrollment grants:<\/p>\n<ul>\n<li><strong>Limited, non-transferable, revocable access<\/strong><\/li>\n<li>Valid only for the specified duration<\/li>\n<\/ul>\n<p>ECF reserves the right to:<\/p>\n<ul>\n<li>Modify program structure or access<\/li>\n<li>Revoke membership in case of violations<\/li>\n<li>Update offerings without prior notice<\/li>\n<\/ul>\n<h4><strong>09. <\/strong><strong>DISCLAIMER OF WARRANTIES<\/strong><\/h4>\n<p>ECF provides services on an <strong>\u201cas-is\u201d and \u201cas-available\u201d basis<\/strong>.<\/p>\n<p>ECF makes no guarantees regarding:<\/p>\n<ul>\n<li>Specific outcomes or results<\/li>\n<li>Personal transformation or benefits<\/li>\n<li>Continuous or error-free access<\/li>\n<\/ul>\n<p>Participation outcomes depend on:<\/p>\n<ul>\n<li>Individual engagement<\/li>\n<li>Consistency of practice<\/li>\n<li>Personal circumstances<\/li>\n<\/ul>\n<h4><strong>10. LIMITATION OF LIABILITY<\/strong><\/h4>\n<p>To the fullest extent permitted by law:<\/p>\n<ul>\n<li>ECF shall not be liable for any indirect, incidental, or consequential damages<\/li>\n<li>ECF\u2019s total liability shall not exceed the amount paid by the user (if applicable)<\/li>\n<\/ul>\n<p>This includes, but is not limited to:<\/p>\n<ul>\n<li>Loss of data<\/li>\n<li>Emotional or psychological expectations<\/li>\n<li>Disruptions in service<\/li>\n<\/ul>\n<h4><strong>11. HEALTH &amp; PERSONAL RESPONSIBILITY DISCLAIMER<\/strong><\/h4>\n<p>Participants acknowledge that:<\/p>\n<ul>\n<li>Meditation and spiritual practices may have emotional or psychological effects<\/li>\n<li>Participation is voluntary and at personal discretion<\/li>\n<\/ul>\n<p>ECF is not responsible for:<\/p>\n<ul>\n<li>Medical conditions<\/li>\n<li>Psychological responses<\/li>\n<li>Personal interpretations of teachings<\/li>\n<\/ul>\n<p>Users are advised to seek professional medical guidance where required.<\/p>\n<h4><strong>12. TERMINATION &amp; ACCESS REVOCATION<\/strong><\/h4>\n<ul>\n<li>Data of individuals under 18 is collected only with parental consent<\/li>\n<li>Any inadvertent collection will be rectified and deleted<\/li>\n<\/ul>\n<h4><strong>13. PRIVACY &amp; DATA USAGE<\/strong><\/h4>\n<p>User data is handled in accordance with ECF\u2019s Privacy Policy.<\/p>\n<p>By using ECF services, you consent to:<\/p>\n<ul>\n<li>Collection of necessary personal information<\/li>\n<li>Communication related to programs and updates<\/li>\n<\/ul>\n<p>ECF does not sell or misuse user data.<\/p>\n<h4><strong>15. THIRD-PARTY LINKS &amp; SERVICES<\/strong><\/h4>\n<p>ECF may provide access to third-party platforms or tools.<\/p>\n<p>ECF is not responsible for:<\/p>\n<ul>\n<li>Content or policies of third-party services<\/li>\n<li>External platform performance or failures<\/li>\n<\/ul>\n<h4><strong>16.
