SCOPE, APPLICABILITY &amp; LEGAL ACCEPTANCE<\/strong><\/h4>\n<p>This Refund, Cancellation &amp; Payment Policy (\u201cPolicy\u201d) governs <strong>all financial transactions<\/strong> made in favor of Enlightened Circle Foundation (\u201cECF\u201d, \u201cwe\u201d, \u201cour\u201d, \u201cus\u201d), a Section 8 non-profit entity.<\/p>\n<p>This Policy applies universally across <strong>all modes, platforms, and touchpoints<\/strong>, including but not limited to:<\/p>\n<ul>\n<li>Official Website and web portals<\/li>\n<li>Learning Management Systems (LMS)<\/li>\n<li>Mobile applications (including present and future applications such as Swadhyan App)<\/li>\n<li>Payment gateways and payment links<\/li>\n<li>Offline registrations and institutional enrollments<\/li>\n<li>Retreats, satsangs, and in-person experiences<\/li>\n<li>Membership programs and community participation<\/li>\n<li>Workshops, seminars, and events<\/li>\n<li>Donations, grants, and voluntary contributions<\/li>\n<\/ul>\n<p>By proceeding with any payment, the individual or entity (\u201cParticipant\u201d, \u201cMember\u201d, \u201cDonor\u201d, \u201cUser\u201d, \u201cYou\u201d):<\/p>\n<ul>\n<li>Confirms having read, understood, and accepted this Policy<\/li>\n<li>Acknowledges the <strong>non-tangible, experiential nature<\/strong> of ECF offerings<\/li>\n<li>Agrees to be legally bound by the terms herein<\/li>\n<li>Waives any claim inconsistent with this Policy, except where mandated by applicable law<\/li>\n<\/ul>\n<h4><strong>02. NATURE OF ENGAGEMENT &amp; OFFERINGS<\/strong><\/h4>\n<p>ECF provides <strong>spiritual, educational, and community-based services<\/strong>, which are inherently:<\/p>\n<ul>\n<li><strong>Experiential and transformational in nature<\/strong><\/li>\n<li><strong>Time-bound and participation-dependent<\/strong><\/li>\n<li><strong>Access-based rather than ownership-based<\/strong><\/li>\n<\/ul>\n<p>These include:<\/p>\n<ul>\n<li>Meditation and inner development programs<\/li>\n<li>Guided spiritual sessions and satsangs<\/li>\n<li>Digital courses, recordings, and structured learning journeys<\/li>\n<li>Membership-based access to communities and teachings<\/li>\n<li>Retreats and immersive offline experiences<\/li>\n<li>Voluntary donations and contribution-based participation<\/li>\n<\/ul>\n<p><strong>Legal Characterization<\/strong><\/p>\n<p>All ECF offerings shall be treated as:<\/p>\n<ul>\n<li><strong>Non-transferable licenses of access<\/strong>, not sale of goods<\/li>\n<li><strong>Irrevocable upon activation or reservation<\/strong>, subject to this Policy<\/li>\n<\/ul>\n<p><strong> PRINCIPLE OF FINALITY OF PAYMENT <br \/><\/strong>All payments made to ECF are <strong>final, binding, and non-refundable<\/strong>, except under explicitly defined exceptions in this Policy.<\/p>\n<p>This applies to:<\/p>\n<ul>\n<li>Membership fees (recurring or one-time)<\/li>\n<li>Program enrollments (digital or physical)<\/li>\n<li>Retreat bookings and seat reservations<\/li>\n<li>Event registrations<\/li>\n<li>Digital resources, content, and learning materials<\/li>\n<li>Donations and voluntary contributions<\/li>\n<\/ul>\n<p><strong>Legal Justification<\/strong><\/p>\n<p>Refunds are restricted due to:<\/p>\n<ul>\n<li>Immediate activation of access rights<\/li>\n<li>Allocation of institutional resources and mentor time<\/li>\n<li>Blocking of limited-capacity seats<\/li>\n<li>Irreversible consumption of digital or experiential services<\/li>\n<li>Operational and logistical commitments triggered upon enrollment<\/li>\n<\/ul>\n<h4><strong>04. LIMITED REFUND ELIGIBILITY <\/strong><\/h4>\n<p>Refunds shall be considered <strong>only in exceptional, verifiable, and documented cases<\/strong>, as outlined below:<\/p>\n<p><strong>4.1 Duplicate or Excess Payment<\/strong><\/p>\n<p>Where the same transaction has been processed more than once for identical services.<\/p>\n<p><strong>4.2 Prolonged Technical Failure<\/strong><\/p>\n<p>Where:<\/p>\n<ul>\n<li>Access to paid services is not provided<\/li>\n<li>Issue persists for <strong>7 consecutive working days<\/strong><\/li>\n<li>Participant has formally escalated and ECF has failed to resolve<\/li>\n<\/ul>\n<p><strong>4.3 Cancellation by ECF Prior to Commencement<\/strong><\/p>\n<p>Where ECF cancels a program\/event before it begins.<\/p>\n<p><strong>4.4 Verified Payment Failure<\/strong><\/p>\n<p>Where:<\/p>\n<ul>\n<li>Payment is successfully debited<\/li>\n<li>Service\/enrollment is not activated due to system or gateway failure<\/li>\n<\/ul>\n<p><strong>Important Condition<\/strong><\/p>\n<p>All refund requests under this clause are subject to:<\/p>\n<ul>\n<li>Internal audit and verification<\/li>\n<li>Technical validation<\/li>\n<li>Administrative discretion<\/li>\n<\/ul>\n<p>Refunds are <strong>not automatic rights<\/strong>, but <strong>conditional remedies<\/strong>.<\/p>\n<h4><strong>05. REFUND REQUEST WINDOW &amp; PROCEDURAL LIMITATION<\/strong><\/h4>\n<ul>\n<li>All refund requests must be submitted within <strong>7 (seven) calendar days<\/strong> from the date of payment<\/li>\n<li>Requests beyond this period shall be <strong>automatically deemed ineligible<\/strong>, unless otherwise required under applicable law<\/li>\n<\/ul>\n<p>Failure to adhere to this timeline constitutes <strong>waiver of refund claim<\/strong>.<\/p>\n<h4><strong>06. ABSOLUTE NON-REFUNDABLE CONDITIONS<\/strong><\/h4>\n<p>The following scenarios shall <strong>categorically disqualify any refund claim<\/strong>, without exception:<\/p>\n<p><strong>6.1 Voluntary Discontinuation<\/strong><\/p>\n<p>Participant chooses to withdraw, discontinue, or disengage for any reason.<\/p>\n<p><strong>6.2 Consumption or Access<\/strong><\/p>\n<p>If the participant has:<\/p>\n<ul>\n<li>Logged into any ECF platform<\/li>\n<li>Accessed any content\/module<\/li>\n<li>Attended any session (online\/offline)<\/li>\n<li>Engaged in any form of participation<\/li>\n<\/ul>\n<p><strong>6.3 Non-Attendance<\/strong><\/p>\n<p>Failure to attend scheduled sessions or events does not constitute eligibility for refund.<\/p>\n<p><strong>6.4 Change of Mind \/ User Error<\/strong><\/p>\n<p>Including:<\/p>\n<ul>\n<li>Incorrect program selection<\/li>\n<li>Lack of clarity prior to payment<\/li>\n<li>Personal preference changes<\/li>\n<\/ul>\n<p><strong>6.5 Breach of Code of Conduct<\/strong><\/p>\n<p>Including:<\/p>\n<ul>\n<li>Disruptive or inappropriate behavior<\/li>\n<li>Non-adherence to community discipline<\/li>\n<li>Disrespect toward mentors or participants<\/li>\n<\/ul>\n<p><strong>6.6 Confidentiality &amp; Intellectual Property Violations<\/strong><\/p>\n<p>Including:<\/p>\n<ul>\n<li>Recording sessions without permission<\/li>\n<li>Sharing internal content or teachings externally<\/li>\n<li>Unauthorized reproduction or distribution<\/li>\n<\/ul>\n<p><strong>6.7 Revocation Due to Misconduct<\/strong><\/p>\n<p>Termination of access due to violations results in <strong>immediate forfeiture of all payments<\/strong>.<\/p>\n<p><strong>6.8 Donations &amp; Contributions<\/strong><\/p>\n<p>All donations are:<\/p>\n<ul>\n<li>Voluntary<\/li>\n<li>Non-refundable<\/li>\n<li>Irrevocable<\/li>\n<\/ul>\n<h4><strong>07. CANCELLATION POLICY FRAMEWORK<\/strong><\/h4>\n<p><strong>7.1 Participant-Initiated Cancellation<\/strong><\/p>\n<ul>\n<li>Allowed only for <strong>future renewals or upcoming cycles (if not commenced)<\/strong><\/li>\n<li>No refund of past payments<\/li>\n<li>Access continues until validity expires<\/li>\n<\/ul>\n<p><strong>7.2 ECF-Initiated Cancellation \/ Modification<\/strong><\/p>\n<p>ECF reserves absolute rights to:<\/p>\n<ul>\n<li>Cancel<\/li>\n<li>Reschedule<\/li>\n<li>Modify structure or delivery<\/li>\n<\/ul>\n<p>Due to:<\/p>\n<ul>\n<li>Operational requirements<\/li>\n<li>Mentor availability<\/li>\n<li>Safety, discipline, or ethical considerations<\/li>\n<li>External or force majeure events<\/li>\n<\/ul>\n<p><strong>Remedies (At ECF Discretion Only):<\/strong><\/p>\n<ul>\n<li>Credit note<\/li>\n<li>Batch transfer<\/li>\n<li>Alternate program allocation<\/li>\n<li>Partial\/full refund (rare, discretionary)<\/li>\n<\/ul>\n<h4><strong>08. THIRD-PARTY PAYMENT DISCLAIMER<\/strong><\/h4>\n<p>All payments are processed via third-party service providers.<\/p>\n<p>ECF shall not be liable for:<\/p>\n<ul>\n<li>Payment gateway errors<\/li>\n<li>Banking delays<\/li>\n<li>Transaction failures<\/li>\n<li>Additional charges imposed by banks\/cards<\/li>\n<\/ul>\n<p><strong>Processing Charges<\/strong><\/p>\n<p>In case of approved refunds:<\/p>\n<ul>\n<li>Gateway or transaction charges may be deducted<\/li>\n<\/ul>\n<h4><strong>09. CHARGEBACK, FRAUD &amp; PAYMENT DISPUTE POLICY<\/strong><\/p>\n<p>Participants are required to contact ECF before initiating any dispute.<\/p>\n<p>Unauthorized chargebacks may result in:<\/p>\n<ul>\n<li>Immediate suspension of access<\/li>\n<li>Permanent account termination<\/li>\n<li>Blacklisting from future participation<\/li>\n<li>Legal recovery proceedings<\/li>\n<\/ul>\n<h4><strong>11. FORCE MAJEURE &amp; LIMITATION OF LIABILITY<\/strong><\/h4>\n<p>ECF shall not be liable for failure or delay due to circumstances beyond reasonable control, including:<\/p>\n<ul>\n<li>Natural disasters<\/li>\n<li>Government restrictions<\/li>\n<li>Public emergencies<\/li>\n<li>Internet\/system failures<\/li>\n<li>Civil or national disruptions<\/li>\n<\/ul>\n<p>In such cases:<\/p>\n<ul>\n<li>Programs may be rescheduled or deferred<\/li>\n<li>Refunds shall not be obligatory<\/li>\n<\/ul>\n<h4><strong>12.
